This document, along with the Privacy Policy, comprise the Plum user's Bill of Rights.
Our Terms of Service and Privacy Policy are currently in draft form and may change. We may make material changes to this document and note them only here.
Your obligations as a member of the Plum communityThese are our terms and conditions of use. Plum is a service that's designed to allow you to collect and share all different types of digital media (in the form of collections). As a member of the Plum community, you have a responsibility to the community as a whole. We expect that you will use the Plum service for its intended purpose, act responsibly, behave appropriately and respect the rights of other members. To give you a clearer sense of what this means, we've summarized your obligations as a member of the Plum community below. By using the Plum service, you are agreeing to be bound by these obligations. If you don't agree to be bound by them, you may not use any of Plum's services.
To facilitate the health growth and operation of the Plum Community and ensure compliance with these terms, Plum may make private or delete content that violates these terms (see below for more details), and, in egregious cases, may terminate your account. Although we're not obligated to do so, we will make our best effort to notify you when we do this and explain to you why we've done it.
Requirements for membership and useWhat this covers:
- This section covers what's required of you in order to use the Plum service as either an unregistered or registered member.
- You must be 16 years of age or older to use the Plum service.
- You must be legally permitted to use the Plum service in your local jurisdiction.
- You will abide by all parts of the Plum User's Bill of Rights.
- You are responsible for all activity that occurs under your user name, you will not share your account information with others, you will maintain only one Plum account, and you will keep your password private.
- You are responsible for all content you include in your collections. You will ensure that you either own or have the right to use any content, of any type, that you collect.
- Any automated use of the Plum service will be through Plum's published APIs or with applications that make use of Plum's APIs.
- You agree that Plum can either make private or delete any content in your collections for any reason (for example, if it is obscene or if it is a copyright violation) and reserves the right to alter content to comply with the Plum User's Bill of Rights. If we make private, delete or alter any content in your collections (except feeds), we will do our best to notify you and provide an explanation, but we are not obligated to do so.
- You agree that your use of the Plum site, APIs, and downloadable software is bound by the applicable license terms, and you agree to comply with these terms.
- You agree that Plum may contact you (for example via the email address you provide during sign-up), to notify you about system updates and service messages, as well as to respond to your requests or feedback.
- Plum can terminate your account at any time for any reason (for example, if you violate any part of the User's Bill of Rights).
What this covers:
- This section covers what you cannot do as a user of Plum's service.
- You must not abuse, threaten, harass, intimidate, impersonate, slander or libel any Plum user, Plum employee, or the Plum service itself.
- You must not use the Plum service for any illegal, unintended, unauthorized or unacceptable purpose. Remember that your use of the Plum service is bound by all applicable laws, and you must comply with the laws of your local jurisdiction when you use the Plum service.
- You must not add any content, of any type, to your collections that is obscene, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, libelous, illegal, or otherwise inappropriate.
- You must not add any content, of any type, to your collections that you do not own, have a license to use, or is not in the public domain.
- You must not use the Plum service for commercial purposes without our prior consent.
- You must not use the Plum service to create or send any unsolicited email ("spam") to any user of the Plum service or external party.
- You must not use the Plum service to collect user names for any purpose, including "spam."
- You must not use the Plum service to transmit worms, viruses or any other code of a destructive or deceptive nature. For example, you may not include worms, viruses or any computer code of a destructive or deceptive nature in your collections.
- You must not include any content in your collections that interferes with the operation of the Plum service.
- You must not create or collect content for the purpose of manipulating, confusing, or altering Plum's search and connections algorithms.
- You will not do anything that interferes with the normal operation of the Plum network or the networks of our partners, agents and access providers.
- Plum will determine what constitutes violation of these terms at our sole discretion. At our discretion, we may take any action available to use, from warning you, to deleting your Plum account or blocking your access to our service.
In order to allow you to use the Plum service in a wider range of ways, we've made both downloadable clients and APIs available to you. Our downloadable clients allow you to collect and use your collections from within a wide range of applications. Our APIs are bits of code that allow developers to extend the Plum service and create innovative and exciting applications that utilize the Plum platform. Our APIs also allow you to integrate Plum content into other things you publish on the Internet (for example, within a blog or personal web site). By using the Plum downloadable clients and APIs, you are agreeing to be bound by these terms. If you don't agree to be bound by them, you may not use them.
What this covers:- This section covers acceptable use of Plum's downloadable clients and APIs.
- It also covers things you should know when using applications that third parties have developed using our APIs.
- Plum's APIs are made available for personal and non-commercial use only. You may, however, distribute applications that make use of Plum's APIs provided that you or others do not derive revenue from the distributed applications, and the distributed applications do not compete with the Plum service.
- You may not use Plum's APIs in any manner that violates Plum's proprietary rights or any applicable laws.
- You will use Plum's APIs and downloadable clients only in a manner consistent with Plum's published documentation.
- You will not remove, obscure or alter Plum's copyright notice, trademarks or any other notice included with our APIs. You also acknowledge that Plum owns all right, title and interest in and to the Plum APIs and Plum-provided downloadable clients.
- The Plum APIs and downloadable clients have not been fully tested or debugged. As such, Plum takes no responsibility for any harm that may result from use of our APIs and downloadable clients.
- You will follow all registration and identification procedures required of users of Plum's APIs. For example, you will use the "API key" assigned to you in a manner consistent with our documentation.
- Applications that incorporate Plum's APIs many not violate the User's Bill of Rights or any other applicable privacy or intellectual property rights.
- Third parties are allowed to create and distribute applications that incorporate Plum's APIs (provided that they follow these terms). Independent developers create these third party applications. As such, Plum cannot guarantee that they will operate in a way that does not cause harm. Nor can we guarantee that your privacy rights will be fully protected by these third party applications. Please take care to ensure that you understand what a third party application does before you use it.
- Plum will determine what constitutes violation of these terms at our sole discretion. At our discretion, we may take any action available to use, from warning you, to deleting your Plum account or blocking your access to our APIs.
- Enforcement and interpretation of our terms and conditions will be at Plum's sole discretion, in good faith and using common sense and reasonable judgment.
